The High Court in Nairobi has ordered Makini School to compensate two pupils unlawfully expelled from the school in 2023.
In his ruling, Justice Lawrence Mugambi said that the school, located in Nairobi violated the dignity and mental well-being of two children, awarding them KSh600,000 as compensation cost for the trauma.
The school’s administration expelled the two pupils following an alleged disagreement between the school and their parents.
The head teacher, Catherine Njuguna, removed the learners from class and handed them termination letters on July 7, 2023.
The school administration directed them to wait for their parents at the school compound’s pickup location.
The parents sued the school, claiming no valid reasons for expulsion.

Advocate Apollo Mboya informed the Court that the minors were among the top-performing students with no history of disciplinary issues.
The Court further said that the expulsion subjected the children to cruelty, causing severe emotional distress.
Mboya described the school’s actions as “malicious, capricious, draconian, and discriminatory,” noting that the expulsion plunged the minors and their family into profound anguish.
Judge Mugambi, in his ruling, pointed out the importance of protecting children’s dignity and well-being within schools.
