The National Assembly’s Committee on Education has recommended changes to two Bills seeking to amend the Universities Act, Cap 210 to limit taxpayer funding for private universities.
The amendments, presented by the committee chaired by Tinderet MP Julius Melly, advocate for the continued placement of government sponsored students in public institutions.
The first Bill, sponsored by Bumula MP Wanami Wamboka, proposes the exclusive placement of government sponsored students in public universities, seeking to exclude private universities from the Kenya Universities and Colleges Central Placement Service (KUCCPS) board.
The gist is that it safeguards public funds in line with constitutional principles of public finance. The Bill would also remove the two vice chancellors (VCs) representing private universities from KUCCPS board.
Melly noted that KUCCPS’ mandate extends beyond university placements, necessitating a careful consideration of the Bills’ implications.

The second Bill sponsored by Christopher Aseka (Khwisero) also introduces adjustments to align with the overall reforms.
Both Bills have received stakeholder input, leading the committee to recommend their approval with amendments.
The move has sparked debate, with proponents arguing for increased support for public institutions as critics caution against marginalizing private universities, which play a vital role in the higher education sub-sector.
