Court stops disciplinary proceedings against KUPPET top officials

The disciplinary proceedings against three top officials of the Kenya Union of Post Primary Education Teachers (KUPPET) over allegations of forging a resignation letter have been halted by the Employment and Labour Relations Court (ELRC).

The hearings were scheduled for tomorrow October 11, 2024.

The National Assistant Treasurer Ronald Tonui and Migori Executive Secretary Samuel Orwa Jasolo moved to court under Certificate of Urgency yesterday to challenge the disciplinary process, arguing that the disciplinary committee established on September 27, 2024 was illegally and unlawfully constituted.

Tonui and Jasolo who have sued the union and Secretary General Akelo Misori, with Registrar of Trade Unions being included in the case as an interested party, argue further that the said disciplinary committee consists of persons who are not fit to hold office and who are out to frustrate them, and that the procedure spelt out in the union constitution in regard to investigations and complaints made to the union was not followed.

Justice (Dr) Jacob Gakeri, sitting at ELRC in Kisumu, ordered the union and the Secretary General to stop the disciplinary process against Tonui, Jasolo and the National Secretary for Tertiary Sammy Chelang’a until the case is heard and determined.

The Judge further ordered that the Notice of Motion be served on the respondents (KUPPET, Misori, and Registrar of Trade Unions) and responded to within 10 days, and further be placed before the trial court on October  23, 2024 for inter parties hearing and/or further directions.

The union top leadership had summoned three top officials: Jasolo, Tonui, and Chelang’a, to appear before its Disciplinary Committee this Friday, October 11, 2024 through letters signed by Misori to respond to allegations of authoring and circulating a fake resignation letter by Misori.
